The US Olympic and Paralympic Committee has filed a lawsuit against Logan Paul and KSI’s Prime energy drink brand, accusing it of trademark infringement. The committee claims that Prime used trademarked Olympic phrases and symbols on a special edition of its hydration drink featuring basketball star and three-time Olympic gold medallist Kevin Durant.
The committee asserts that it does not have an agreement with Prime for the use of its terminology and trademarks and described Prime’s actions as “deliberate” and “in bad faith.” The lawsuit, filed in Colorado on Friday, also accuses Prime of using the trademarks in online campaigns and promotions.
According to the lawsuit, consumers could be misled into believing there is an endorsement or agreement between the US Olympic and Paralympic Committee and Prime. Despite the committee issuing a cease and desist letter to Prime, the drinks brand allegedly continued to market the product using the Olympic branding.
Prime has previously faced criticism for marketing to a younger audience, leading some schools in the UK to issue warnings or bans. While Prime’s energy drink contains caffeine, it also offers a caffeine-free hydration drink.
Earlier this month, US Senate Majority Leader Chuck Schumer called for an investigation into Prime due to the high caffeine content in its energy drink. Prime responded by stating it complies with regulatory requirements in all countries where it operates.
Logan Paul and KSI, who have over 40 million YouTube followers between them, launched Prime in the UK in 2022. The release generated significant hype, resulting in some stores limiting the number of bottles per customer. Prime has collaborated with top sporting stars and teams worldwide, including Arsenal and the LA Dodgers.
